11:BioPorto wins lawsuit filed against Phadia

The Maritime and Commercial Court of Copenhagen issued a ruling today in a lawsuit filed by BioPorto against Phadia concerning the nullification of Phadia’s European patent DK/EP 0 756 708 in Denmark.BioPorto’s assertion that the patent’s claims 1 and 2 are invalid in Denmark was upheld by the Maritime and Commercial Court.At the same time, the court did not accept Phadia’s claim for compensation in tort for BioPorto’s sale of NGAL kits.Phadia can appeal the ruling.

The lawsuit was filed against Phadia on December 8, 2006, particularly for the purpose of nullifying claim 1 of the patent which specifies the use of HNL (another name for the NGAL protein) as a diagnostic marker for human diseases.
