Objections from CCH against the resumption of grant proceedings
In continuation of BioPorto’s previous announcements about patent rights to NGAL, it is hereby announced that the European Patent Office (EPO) has received objections from CCH against EPO’s decision to resume grant proceedings for BioPorto’s European patent application, EP 1 831 699.
The objections contain references to correspondence between BioPorto and CCH in relation to CCH’s purchase of BioPorto’s (AntibodyShop’s) antibodies. BioPorto is naturally fully aware of the cited correspondence as well as further correspondence between the two organizations. The contents of the correspondence in no way supports CCH’s claim to BioPorto’s cutoff patent, but merely records CCH’s purchase and use of BioPorto’s antibodies.
In the course of the examination process, EPO has already concluded that CCH and BioPorto have made two different inventions. EPO has therefore been unable to confirm the similarities alleged by CCH. In coming written submissions to the Danish Maritime and Commercial Court and to EPO, BioPorto will justify in depth its proprietorship of the NGAL cutoff patent.
